Court Upholds Indictment Against Home Center for Operating on Shabbos

The Tel Aviv Area Labor Court rejected a request by Home Center to annul the indictment filed against the hardware chain for employing Jewish workers at its Herzliya branch in violation of the Work and Rest Hours Law. Home Center claimed that the Ministry of Commerce and Industry singled it out while refraining from issuing reports and indictments against similar businesses, particularly cellular companies, computer stores and the shops at Ben Gurion Airport. At Ben Gurion the State even issued a tender for concessions that required winners to keep their stores open on Shabbos.

Nevertheless the Labor Court found that the evidence of alleged discrimination Home Center presented was insufficient, saying nobody compelled the chain to operate on Shabbos or to employ Jewish workers. The development could set a precedent for other court decisions backing the Work and Rest Hours Law.
