Retired Dayanim and Beis Din Advisers to be Certified
Arbitrators
by Eliezer Rauchberger
Following a demand by Deputy Education Minister Rabbi Avrohom
Ravitz, former dayanim, potential dayanim and
rabbinical court advocates (to'anim rabbonim) will be
included on the list of certified arbitrators.
Four years ago the Knesset passed a law allowing courts to
send various cases brought before them to arbitration
proceedings. The Justice Ministry formulated regulations on
who is permitted to engage in arbitration, how to obtain an
arbitrator's license, and so on but, following a High Court
ruling, a need arose to formulate new regulations in the
Knesset.
Last week there was a meeting of the Knesset's Constitution,
Law and Justice Committee to approve the regulations. Justice
Ministry officials arrived bearing a list of approved
arbitrators, including professionals such as lawyers and
former judges. Rabbi Ravitz asked that the list also include
former dayanim, potential dayanim (those having
passed the eligibility requirements) and beis din
advocates, claiming former dayanim are no less
qualified to handle arbitration than former judges and
beis din advocates are no less qualified than
attorneys.
Committee members accepted MK Ravitz' claims and agreed to
his request. Chairman MK Michael Eitan (Likud) announced he
also supported these suggestions and when the regulations are
brought for a final vote he would ensure these types of
professionals are included on the eligibility list, based on
various other criteria.
