The Yad Shmuel Beis Din for Arbitration, headed by HaRav Mordechai Gross, the av beis din of the Chanichei Hayeshivos Center in Bnei Brak, was set up with the blessings of HaRav Yosef Sholom Eliashiv shlita.
The arbitration court helps disputing parties settle monetary disputes. The disputants select the dayonim, who must issue a ruling by a set date. An electronic transcript of the hearing is kept, and provided to the respective parties at the conclusion of the proceedings. The disputants can appeal the ruling and the dayonim will respond in writing to each and every claim.
The ruling is thoroughly explicated to ensure that the issues are clearly understood by the disputing parties and is very detailed to enable a secular court to approve it and enforce the ruling, should one of the parties refuse to abide by it. The beis din will not issue restraining orders if the two sides did not agree to the arbitration and will not send summons to beis din.
HaRav Gross appointed HaRav Yitzchok Birech Daskal, a prominent dayan in the Chanichei Hayeshivos beis din and the author of Shiurim Kesidran Al Bava Metzia, to head the arbitration beis din.
